Judge Barbara Hervey Files for Re-Election

to the Texas Court of Criminal Appeals

AUSTIN, Texas – Judge Barbara Parker Hervey announced today that she has filed for re-election to the Court of Criminal Appeals (CCA).  Elected in November 2000, Hervey is seeking her third term as the Republican nominee for Place 7 at the CCA.

Hervey received her B.A. from the University of North Carolina at Greensboro, and she earned her J.D. from St. Mary’s University School of Law in San Antonio in 1979.  She began her legal career in private practice, before becoming an Assistant Criminal District Attorney at the Bexar County District Attorney’s Office in San Antonio.  In 1990, Hervey was named a First Chair of the Appellate Section of the District Attorney’s office.  She represented the State of Texas in appealing criminal matters and worked for the District Attorney’s office for 16 years.

The Court of Criminal Appeals is Texas’ highest court for criminal matters.  The structure and jurisdiction of the CCA are derived from the laws of the State of Texas and the Texas Constitution.  Comprised of eight judges and one presiding judge, all nine positions are elected by a state-wide vote and each judge serves a staggered term of six years.  In 2009, the CCA handled almost 9,000 cases, one of the largest workloads in the country.

Hervey helped to establish the Criminal Justice Integrity Unit and currently serves as its chair.  The Unit was founded to strengthen integrity in the criminal justice system by training prosecutors, judges, defense attorneys, and law enforcement officers in areas such as eye-witness identification procedures to ensure we apprehend the real perpetrators of crime.  Hervey is also the chair of the CCA’s Grants Committee.  Through the Committee the CCA controls approximately $18 million per biennium of grants for continuing legal education.

In addition to being a published author, Hervey has been an adjunct professor since 2004 teaching Texas Criminal Procedure.  She has also been awarded the Rosewood Gavel Award for Outstanding Judicial Service and was honored as a distinguished alumna in 2009.
